台北市長柯文哲。（資料照，記者叢昌瑾攝）這已經是柯文哲上任未滿百日以來，不曉得第幾次先震怒後道歉了，但從他這次的自省來看，還是沒有抓到癥結點。何以會「氣瘋了」？難道不是因為你當場 想到了「指鹿為馬」的典故？柯文哲讀太多中國那一套宮廷內鬥的故事，把箇中情節投射在台北市府，一想到部屬那麼奸詐，自己又被當成顢頇的領導者，當然會抓 狂。
奉勸柯文哲，中國冊不要讀太多，否則頭殼會壞去！柯文哲擬把台北市公車改為里程計費，理由是「符合中國人斤斤計較的精神」，拜託，台灣人不是中國人，台灣人更沒有斤斤計較的習慣，不要時空錯置了。
幾個月來，好多人呼籲柯文哲，必須在人文與社會科學上多加進修，但顯然他的閱讀範圍，就侷限於中國典籍。柯文哲一再怒飆下屬的問題，讀《論語》根本幫不上忙，而是必須培養同理心與信任感，不要再把同仁都當成笨懶壞，動不動就當眾耍狠斥罵了。

有錢固能使鬼推磨，但錢終非萬能。在滿足了金錢的慾望之後，對等與尊重，恐才是周邊鄰國所渴望的擔保。而對內，當經濟下滑，基層民不聊生，習近平卻 在玩動輒幾百個億美金的外交砸錢遊戲，不能說一點風險也沒有。只是，在一言堂之中，以中國之大，竟無人提出不同見解。相反地，卻處處可見歌功頌德的應聲 蟲。而再看看中國高官與富人一個個捲款至國外置產與眾多純真的臉龐在習近平的指揮棒下高唱「中國夢」的那一幕不協調的畫面，實在令人有點心酸而不忍置評。

星期專論》後學運時代的新挑戰！

一九六○年代是歐美學生青年運動沛然而興的年代。後來的學者在進行反思時，認為當一個社會的「社會內容」，超過了「社會文法」所能負荷的程度，不滿就會形成，顛覆掉舊的程序和執行舊秩序的人。因此學運和青運，乃是一個社會創新的開始。
現在「太陽花學運」已滿週年，也到了人們思考學運的時候。學運顛覆了什麼？宣示出了什麼是創新的方向？這都是人們在構思「後太陽花學運」的政經社會重要的課題。
「九二共識」應全部丟棄
過去的台灣，基本上是個被「過去」牽著走的社會，而不是一個「走向未來型」的社會，無論國家的集體認同、各種權力體的運作規範，甚至人民的權利義務 關係，都被「過去」所制約。它累積成了一個保守專擅的威權體制。極少數擁有權力的官僚，根據他們褊狹的思維，就想宰制整個社會。馬政府違背台灣人民核心利 益的兩岸政策，以及由此而形成的服貿協議，並企圖靠著它的粗暴權力硬闖過關，於是引爆了學運以及對學運的鎮壓。由這個過程，其實已勾勒出了幾個未來台灣最 重要的課題：（一）就台灣內部而言，由於台灣社會內容的改變，一種共識型的溝通民主已必須形成，黨政官僚為本位的紀律式民主已必須揚棄。
（二）對台灣外部而言，集體的認同乃是自然形成的，而今天台灣的新認同業已出現，已必須根據新認同來形成國家方略和對外關係，以及台灣發展的路線 圖。我即認為，兩岸關係必須全部重來，要重新建立一種「不必共識的平等對話關係」，國民黨和馬政府自以為得意，其實是自欺欺人、作繭自縛，使台灣自墜陷阱 的所謂「九二共識」，應全部丟棄。在國際社會上，並沒有「共識」這種東西，只有尊重、平等，對話才是最根本的前提。台灣不論任何政黨或團體，都有必要堅持 這個真正的底線，並向北京表示，中國也應建立基本的行為規範。
（三）未來台灣的領導階層，已需根據新認同，形成台灣新的核心利益和核心價值，制定新的國家方略，改變國民黨和馬政府依賴中國的心態和方向。
而上述三個「後太陽花學運」的大問題，都是極為艱難的問題。台灣內部是否能形成這些「台灣共識」，仍需大家付出極大的努力。於是我就想要一談西方在六○年代後出現的階段性癱瘓現象。
既有權威易受傷害性擴大
西方在六○年代學運後，學運也催動出社群的公民運動。於是西方進入了人人有話就說、有不滿就嚷的階段。於是美國和英國的政治遂出現階段性的無能癱 瘓。地方和中央政府因為群眾運動太多，任何事都有人反對嗆聲，於是為了少被罵，大家遂養成了一種少惹事的心態。遇到問題不立刻做決定，讓社會自己去吵成一 團，等到吵出一個結果後，才順勢而行。英美學術界在一九七○年代，對這種政府的癱瘓研究甚多，並因而成為好幾個學派。這顯示出學運和青運會打鬆一個社會的 結構，除非運動後能快速的沉澱出正面的社會力量，否則都會不利於權威和新秩序的形成。就以最近的慈濟風波和民進黨的發言人風波，都對慈濟和民進黨造成極大 傷害，即顯示在後太陽花學運時代，人民的期望增加，批判力道加強，既有權威的易受傷害性也告擴大，如果不能與時俱進，只要出了一點重大紕漏，必定會受到人 民以高標準來檢視和批判。既有權威的易受傷害乃是後學運時代必然的趨勢。新興勢力整合難度高
因此，在這個後學運時刻，其實乃是個競爭更嚴苛的時代。有志於在未來扮演領導或主導角色的，一定要本於未來性的思維，替台灣的未來作出開創。而我並 不敢對國民黨抱有期望。國民黨自從去年敗選後，如果它是個有反省力的政黨，那就是它脫胎換骨、尋找新生的機會。但至今為止，沒有任何跡象看出它有這種企 圖。它只是構想要伺機反撲，卻未對未來的台灣走向作出任何規劃，國民黨不去想未來，它當然不可能贏得現在！毫無疑問的，民進黨現在是走在順風的時刻，但民進黨的努力顯然仍不夠：
—目前的台灣，各種新興的青年及公民運動團體興起，理論上，這些新興勢力乃是民進黨的「彩虹聯盟」夥伴。但根據外國的經驗，「彩虹聯盟」的互利共生，卻是高難度的整合與互動，否則就反而互害，而至今人們仍看不到這種整合。
—將來到了愈接近二○一六選舉，民進黨的挑戰必紛至沓來，甚至還會總爆發。許多問題的挑戰動能，必須讓它逐次預先發散掉。逐漸的發散，也有利於把一 些問題說清楚講明白。如果將來總爆發，許多問題反而糾纏不清。因此民進黨理應有自己談論問題的日程表，將各種挑戰逐漸發散。這方面的努力人們仍未看到。
後太陽花學運時代，乃是台灣走向未來新挑戰的開始，台灣的政黨和有志者還需更加努力！

英國首例 無人機運毒闖監獄

〔編譯周虹汶／綜合報導〕一架空拍遙控飛機本月初載著毒品、手機、鋒利的刀片和螺絲起子，企圖飛進英國東部貝德福德監獄（Bedford Prison）。雖然這架無人機闖關失敗，卡在監獄四周架設的有刺鐵絲網中，但以無人機夾帶違禁品入監卻是英國首例，英國各監獄已因此提高警戒。
六 日晚間十一點卅分許，一架中國「大疆創新」公司製造的空拍飛行機「Phantom2」，運載一個夾帶前述違禁品的包裹，被發現卡在監獄外圍的鐵絲網上。當 地警方正與獄方合作調查，釐清主使者身分。貝德福德監獄屬中等戒備監獄，約可容納五百名囚犯，曾被評為管理良善、不易取得毒品。大疆創新則為全球最大民用 無人機製造公司，Phantom2售價不到五百英鎊（約台幣兩萬三千五百元）。

中國社科院發表《二○一五法治藍皮書》，首次提到若中央認為人大決定「不適當」，亦可撤銷或改變，並非一貫所說「不可撼動」。港府發聲明重申人大決定「是
不會撤回，亦不會修改」。究竟《藍皮書》是否意味過去大半年中共信誓旦旦的「不可撼動」說有些鬆動呢？
報告稱，在理論上，全國人大有權改變或者撤銷人大常委「不適當的決定」，但前提是，有關決定必須是「不適當的」。當中央認為是適當的決定時，在中國的憲政架構下，「全國人大是不可能改變和撤銷這決定的」。
這 裏有幾個要點，一是改變過去說人大常委的決定有最高權威性因而「不可撼動」，終於承認是可以改變的；二是只承認「理論上」可以，實際上卻要中央認為人大常 委決定是「不適當的」才可以，而中央似乎還未認為「不適當」；三是「在中國的憲政架構下」，人大應該是最高權力機構，但不是，《藍皮書》表示最權威是「中 央」，中央不是指國家權力的中央，而是沒有明說卻不言而喻的「黨中央」。也就是說，什麼人大決定是最高權威，「不可撼動」，都是騙人鬼話，真正權力是黨中 央。在一黨專政之下，沒有真正法治，沒有真正學術，沒有獨立傳媒，不管是大陸法律學者，是政協主席、總理或哪一級高官，也不管是多高級的機構，都只會重複 黨中央定下的調調。泛民去上海見李飛，或李飛來香港見泛民，都沒有意義。
什麼才會讓中央覺得某個決定「不適當」呢？就是現實政治情況的變化。只要 政治上行不通，憲法可以改，黨綱可以改，過去在憲法黨綱寫進誰當接班人，政治情勢有變，說改就改。沒有高於專政權力的憲法、法律，也沒有高於一黨的國家立 法機關。中共國明言：「依法治國，是黨領導人民治理國家的基本方略」。所以，跟隨中共講法治，講人大權威性，多餘啦。香港人爭取民主的對手只有一個，就是 絕對權力的中共中央。中央說人大決定「適當」就適當，說「不適當」就不適當；中央領導人換了，適當也隨時可以變不適當。
從前年三月喬曉陽在深圳和 建制派談話提出「三個堅定不移」之後，兩年來中共沒有任何改變，也沒有任何鬆動。而且越來越強硬，先來一個國務院白皮書，再來一個人大決定，都是重複和加 強喬曉陽的原說辭。原因何在？就因為在中共毫無鬆動迹象的情勢下，香港不斷有民主人士提出各種自動降價的方案。這樣中共又何須鬆動？它看準了只要不斷強硬 下去，香港人遲早就範。只重實力而不講道理的專政政權，是不可能在得勢時讓步的。

報告稱，在理論上，全國人大有權改變或者撤銷人大常委「不適當的決定」，但前提是，有關決定必須是「不適當的」。當中央認為是適當的決定時，在中國的憲政架構下，「全國人大是不可能改變和撤銷這決定的」。
這 裏有幾個要點，一是改變過去說人大常委的決定有最高權威性因而「不可撼動」，終於承認是可以改變的；二是只承認「理論上」可以，實際上卻要中央認為人大常 委決定是「不適當的」才可以，而中央似乎還未認為「不適當」；三是「在中國的憲政架構下」，人大應該是最高權力機構，但不是，《藍皮書》表示最權威是「中 央」，中央不是指國家權力的中央，而是沒有明說卻不言而喻的「黨中央」。也就是說，什麼人大決定是最高權威，「不可撼動」，都是騙人鬼話，真正權力是黨中 央。在一黨專政之下，沒有真正法治，沒有真正學術，沒有獨立傳媒，不管是大陸法律學者，是政協主席、總理或哪一級高官，也不管是多高級的機構，都只會重複 黨中央定下的調調。泛民去上海見李飛，或李飛來香港見泛民，都沒有意義。
什麼才會讓中央覺得某個決定「不適當」呢？就是現實政治情況的變化。只要 政治上行不通，憲法可以改，黨綱可以改，過去在憲法黨綱寫進誰當接班人，政治情勢有變，說改就改。沒有高於專政權力的憲法、法律，也沒有高於一黨的國家立 法機關。中共國明言：「依法治國，是黨領導人民治理國家的基本方略」。所以，跟隨中共講法治，講人大權威性，多餘啦。香港人爭取民主的對手只有一個，就是 絕對權力的中共中央。中央說人大決定「適當」就適當，說「不適當」就不適當；中央領導人換了，適當也隨時可以變不適當。
從前年三月喬曉陽在深圳和 建制派談話提出「三個堅定不移」之後，兩年來中共沒有任何改變，也沒有任何鬆動。而且越來越強硬，先來一個國務院白皮書，再來一個人大決定，都是重複和加 強喬曉陽的原說辭。原因何在？就因為在中共毫無鬆動迹象的情勢下，香港不斷有民主人士提出各種自動降價的方案。這樣中共又何須鬆動？它看準了只要不斷強硬 下去，香港人遲早就範。只重實力而不講道理的專政政權，是不可能在得勢時讓步的。
現在似乎有點鬆動了，原因是二十七名民主派議員聯署會否決政府方 案。因此而使高官和建制派紛紛表示對通過政改不樂觀，也有自認掌握北京意向的人說中央「打定輸數」。在不斷有消息說某某民主派會轉軚、部份民主派又期待與 中央大員會談的情況下，這聯署展示了實力。如果政改方案果真被否決，那就是下一級的香港立法會否決了被認為最高級的人大決定，「不可撼動」就不僅撼動而且 推倒了，中共沒有面子事小，在全國幹部人民面前失去黨和人大的權威性則茲事體大。因此中央（社科院也代表中央）開始放出鬆動口風了。
