臺北市政府警察局執行104年「0723反黑箱課綱專案」安全維護工作專案檢討報告
緣起
一、教育部對現行「98課綱」進行調整，並提出新版「103課綱」，引起學生、家長、教師、社運團體不滿，認為教育部調整課綱之程序與內容不當，遂發起「反黑箱課綱」運動，並舉辦一連串陳情、抗議、座談會等活動。
二、 104年6月10日起「反黑箱課綱」抗議活動即在教育部前舉行，鑑於抗議活動日趨激烈，在104年6月24日游姓學生（高職應屆畢業生）翻越教育部圍牆丟 擲油漆包，經教育部報警後到場處理，教育部保留告訴權，遂由環保局依廢棄物清理法裁處；7月6日游姓學生於教育部陳情時推擠員警並強行翻越大門（經警方即 時管束、告誡後放行，教育部保留告訴權）；7月13日游姓學生帶領學生10名拉開國教署2樓鐵捲門，並闖入5樓署長室外，要求署長出面回應（經警方及國教 署勸離後，教育部保留告訴權）；7月17日6名學生夜間翻越教育部中庭，在主體建築物及石柱、圍牆噴漆（經報警後依法逮捕，其中4人坦承犯行，教育部保留 告訴權，警方遂依社會秩序維護法第90條第2項裁處）。教育部請求警方在部內圍牆架設鐵拒馬及蛇腹型鐵絲網，維護教育部駐地安全，並避免學生因圍牆低矮可 輕易翻越圍牆侵入教育部。同時教育部與警方於7月11日召開安全維護協調會議，會議中達成決議抗議人士如有違法、違序行為，教育部將依規定報案、提告，要 求警方能依法協助排除，再視狀況架設阻材。此外，如群眾在上班時間占據教育部廣場，部內仍會派員協調接受陳情，協調不成後再請求警方抬離。若群眾係在下班 時間闖入廣場，顯係惡意占領，則將請警方即時強制執法。
三、反黑箱課綱團體成員蔡ＯＯ期望以合法和平方式舉行「722，包圍教育部」活 動，故於7月21日以緊急集會方式，向警察局中正第一分局申請於104年7月22日13時起至7月23日22時止，在中山南路【徐州路（不含）至濟南路1 段（不含）間】東側慢車道及人行道，舉行連續跨夜之集會活動。該分局亦基於保障民眾合法集會權利，立即協助取得路權並核准前述申請，警方基於保障合法集會 之立場，派員到場維持交通秩序。22日晚間21時30分許部分媒體報導並謠傳警方將於23時逮捕未成年人，該分局張分局長立即當面告知主持人，警方保障合 法集會，不會逮捕任何人，並即時發布新聞稿澄清。「北區反課綱高校聯盟」總召朱Ｏ在7月23日上午10時宣布，本次集會因無法達到訴求而提早結束，學生將 前往當（23日）晚間教育部於各區舉辦之課綱微調校園座談會，與教育部官員對話。集會和平結束後，各區座談會亦於當日20時35分許陸續結束，並未發生違 法違序情事。
「0723非法入侵教育部」案情摘要與執法作為
一、依報載，學生王ＯＯ召集學生於7月23日教育部座談 會結束後，至青島東路台灣北社辦公室召開會議，並決定於23時35分違法自教育部之合作社圍牆，架設長梯攀越屋頂後，藉由教育部交通車車頂，侵入教育部； 另有部分群眾則違法毀損北側大門及蛇籠後，侵入教育部。據駐衛警許ＯＯ陳述，群眾不顧駐衛警攔阻，自大門闖入教育部建築物內，亦破壞後門闖入，毀損建築物 內服務臺、桌椅、電腦線等物品，並以桌椅堆疊於門口，強行占領部長室及阻擋駐衛警進入。
二、教育部當日輪值留守之新聞工作小組教官謝ＯＯ、駐衛警許ＯＯ於23時38分向110報案臺報案，請求警方協助。
三、 中正第一分局獲報後，該分局張分局長奇文立即指示與調派所屬夜間服勤之正（副）所長及員警約30名警力，陸續趕抵現場處置，並趕赴現場擔任指揮官，由於本 案係屬刑事案件，逐依刑事訴訟法之規定，於24日0時10分，進行危害排除及刑事案件強制作為，逮捕非法入侵教育部之犯罪嫌疑人。
四、 經查教育部當時周邊圍牆均以鐵拒馬、蛇籠作為安全防衛，欲進入教育部者，均應通報教育部人員放行，該等非法入侵均涉嫌刑法第306條無故侵入他人建築物 罪；破壞建築物內物品之群眾，另涉有刑法第354條毀損罪，故警方到場後均依刑事訴訟法第88條規定，以現行犯逮捕（事後清查現場逮捕33人(26男7 女，其中7男4女未成年；具有學生身分計24名《包括大學在學學生10名、高中在學學生12名、高中休學學生2名》；記者3名)，惟對於在場犯嫌之隨身手 機、相機及電腦設備均未予扣押。
五、7月24日1時40分許，因教育部圍牆外有近百名聲援群眾，並有持續增加現象，為避免事端擴大，除分批將逮捕之群眾送至本局保安警察大隊偵詢，再向警察局申請支援警力到場維護秩序。
六、 在逮捕之33名群眾尚未送至保安警察大隊時，聲援群眾聚集於教育部中山南路大門外持續叫囂，要求釋放學生，至逮捕之33名群眾均安全抵達保安警察大隊後， 張分局長乃持麥克風安撫聲援群眾情緒，並告知遭逮捕群眾已後送至保安警察大隊，請群眾返家休息。後張分局長於7月24日4時15分針對持續聚集在教育部中 山南路大門外聲援之群眾，因有影響公共秩序、社會安全之虞，對為首之民眾王ＯＯ、黃ＯＯ、慕ＯＯ、蕭ＯＯ等人實施勸導，請渠等將群眾帶離現場。隨後依據警 察職權行使法第27條規定，率隊自教育部中山南路大門口南側，沿中山南路東側慢車道往北經濟南路，將群眾柔性勸離至林森南路、濟南路口西北角，過程中均無 任何衝突情事發生，現場群眾並於6時30分全數離去。
七、遭逮捕之群眾於7月24日3時0分全數送抵保安警察大隊時，3位法扶律師及部分立法委員助理均已到場協助，對未成年人部分，亦同步通知該等家屬，且製作筆錄時，全程均有律師陪同。
八、警方於24日5時29分在保安警察大隊開始製作筆錄，9時5分完成33位被逮捕人第一次詢問筆錄。
九、 臺灣臺北地方法院檢察署謝姓等4名檢察官，於24日9時50分抵達保安警察大隊，複訊22名成年嫌犯；11位未成年人(7男4女)則於24日11時35分 移送臺灣臺北地方法院少年法庭，其中邱ＯＯ(女)因身體不適由警方及其父母先行陪同前往三軍總醫院松山分院就醫後，再行移送少年法庭。
十、11位未成年人經少年法庭審理後，均責付家長帶回；22名成年嫌犯（含3名記者）經檢察官複訊後，均裁定1至3萬元交保，復因3名記者拒絕交保，承辦檢察官改裁定限制住居。
爭議事項說明
一、警方當（23日）晚接到教育部報案後，執法作為為何？有無對現場員警進行勤前教育？
因 本次勤務係屬突發狀況，該分局張分局長均有責付當晚帶隊幹部針對執勤員警當面實施勤教。另張分局長於24日4時15分在教育部中山南路大門外，對群眾實施 柔性勸離前，亦先召集執勤員警於徐州路口實施勤前教育，再次要求員警在執勤過程中務必注意保護民眾及媒體安全，採取柔性勸離，不可粗暴行為造成民眾受傷。
二、警方有無以警械逮捕學生或未成年人？並有沒收手機、限制通訊等情事？
（一） 本次群眾違法自教育部臨濟南路之合作社圍牆架設長梯攀越屋頂或違法翻越北側大門蛇腹型鐵絲網侵入教育部，經駐衛警攔阻仍置之不理，強行闖入教育部建築物 內，再佔領部長室。經教育部報案及依刑法第306條、354條等罪提起告訴，該分局遂依據刑事訴訟法之規定依法執行逮捕等相關程序。另警方抵達教育部時， 為避免群眾持續有不理性及非法脫序而恐生自傷或傷人情形發生，且初期到場警力尚未形成絕對優勢，在場司法警察適時對違法群眾以手銬、束帶實施管束，其比例 原則依法尚無違誤之處。
（二）本案因涉及違反刑法第306條、354條之規定，該分局依據刑事訴訟法之規定進行危害排除及刑事調查程序，惟勤務中無扣押民眾之手機、相機等物品。
三、警方逮捕在場採訪記者，適法性為何？
經 查教育部當時周邊圍牆均以鐵拒馬、蛇腹型鐵絲網圈圍，一般民眾無法以正常方式進入教育部內。故警方在確認教育部將對違法入侵之群眾提告後，曾再向在場3名 記者詢問，是否係當晚即於部內留守至今或經駐衛警同意後進入該部。惟3名記者均表示未經教育部同意，而係與群眾一同翻越教育部圍牆入內；復經檢視群眾自行 上傳之照片，3名記者在群眾著手違法架設長梯、侵入教育部廣場時，即在現場攝影記錄，隨後與群眾一同違法侵入教育部圍牆及建築物，經查事先未有向教育部申 請之證明，違法行為事證該當，並無不予移送之事由，特予澄清。
四、為何警方未依標準作業程序於現場編派「媒體聯絡人」作為警方與記者間溝通、聯繫之橋梁？
因 教育部當時周邊圍牆均以鐵拒馬、蛇腹型鐵絲網圈圍管制，並發生群眾違法入侵、毀損情事，係屬刑案現場，記者應在警戒封鎖線外實施採訪。因當時並非執行集會 遊行勤務，故無須編排「媒體聯絡人」，且該分局在7月24日於教育部外中山南路前，實施柔性勸離行動，全程未限制任何媒體採訪自由，顯示該分局有確實遵守 警察局104年1月1日公布「警察局執行集會遊行與媒體協調之工作守則」，落實「保障新聞採訪自由」及「保護記者人身安全」工作。
結語
集 會、遊行係憲法保障之權利，對於民眾集會、遊行活動，本府警察局仍將持續落實憲法保障人權之意旨及人權兩公約相關規定，秉持「保障合法、取締非法、防制暴 力」原則，依法行政，兼顧公共利益之均衡維護；另對於人民陳情、抗議活動，將視活動團體動員人數及屬性，妥適、彈性規劃勤務派遣警力，以維護活動現場安全 及交通秩序。另加強員警教育訓練，灌輸人權教育觀念，注意執勤技巧及態度，以服務及柔性方式，確實保障合法活動，適切執法。

哈里斯談話 美對南海最強烈說法

他說，過去45年來，越南、馬來西亞、菲律賓和台灣也在南海填海，但總共只填了100畝，相較於北京大舉造島的面積與範圍如同小巫見大巫；中方18個月內就填了3000畝。

report notes that women and girls from mainland China and Southeast
Asian countries, it is through false marriages or false employment
opportunities for Taiwan to engage in sex trafficking. However,
there are some women recruited in Taiwan to Japan, Australia, the
United Kingdom, and the United States to find work, to the post then
forced into prostitution by local classified ads.

報告提到，台灣當局完全符合消除人口販運的最低標準。在報告調查期間，台灣當局持續對販運罪進行起訴，包括強迫勞動和強迫賣淫；並訓練執法人員和其他政府官員了解人口販運指標；提升大眾對於人口販運犯罪的認識。對於台灣的狀況，報告指出，台灣大多數人口販運的被害人是來自印尼、菲律賓、泰國及越南的外籍勞工，少數則來自中國大陸和柬埔寨。台灣有超過55萬名外籍 勞工，大多透過仲介機構或掮客引介赴台從事低技術門檻的工作，像是家庭看護、幫傭或在農業、製造業、營建業和漁業等產業服務。
報告提到，外勞仲介藉由收取高額仲介費控制外勞，部分在台外勞因此實質所得還不及台灣的最低薪資；而外籍幫傭和看護因為和雇主同住，難以監控其工作和居住狀況，尤其容易遭到剝削。
此外，只要外勞抱怨，外勞仲介經常會協助雇主將那些「有問題」的外勞遣送回國，導致仲介可以找新的外勞填補職缺，再持續把外勞當「債務奴」（debt bondage）進行控制。而來自大陸、印尼和越南的漁工則遭受低薪、長工時、身體虐待、食物不足等待遇。
報告指出，來自大陸和東南亞國家的婦女與女童，則透過假結婚或不實受雇機會赴台從事性販運。不過，也有部分台灣的婦女經由分類廣告的招募到日本、澳洲、英國、和美國找工作，到了當地後則被迫賣淫。

An Oregon software programmer is publicly taunting President Obama to come arrest him after he openly defied an executive order that appears to prohibit Americans from supplying cyber-currency to Edward Snowden.
Kristopher Ives, who lives in Lafeyette, sent Snowden about 33 cents worth of bitcoin in defiance of the presidential order.
"It's not much but it's the principle of the matter," Ives wrote on the social networking and news site Reddit : "Please come arrest me. I live in Oregon and my name is Kristopher Ives and you can reach me at 503-383-1047."
Ives told The Oregonian on Friday that he was on Reddit on Wednesday, April 1, when news of Obama's executive order hit the Internet.
At first, he thought it might be an April Fools' Day prank.
"I don't want to play the tin foil-hat person," he said, "but it just seemed so odd to (sign an executive order) on April Fools."
So the 28-year-old self-professed "nerd and gamer" hunted up the executive order on the Federal Register. And there it was.
The order - "Blocking the Property of Certain Persons Engaging in Significant Malicious Cyber-Enabled Activities" - struck Ives and many other observers as a way to stop Americans from sending Snowden bitcoin .
Edward Snowden, you'll recall, is the former National Security Agency contractor who walked off with troves of classified files in 2013 and leaked them to journalists. Snowden fled to Moscow, where he was granted temporary asylum.
The public is divided on Snowden, who is characterized as a turncoat by the US government, which has charged him with espionage. Snowden supporters describe him as a hero who blew the whistle on -- among other things -- a Foreign Intelligence Surveillance Court order that allowed the NSA to collect the telephone data of millions of ordinary Americans.
Ives falls into the Snowden-as-hero camp.
He said in Friday's interview that he thought Snowden was this generation's Mark Felt, the FBI official known as " Deep Throat " who leaked information about the Watergate scandal to The Washington Post. President Richard M. Nixon resigned amid those revelations.
Ives believes that the executive order prohibits Americans from sending bitcoin to Snowden's relief fund, and he's not alone. The business technology website ZDNet published a piece Friday noting that the online community has seized on the loose wording of the presidential order and is riled up because it "effectively rules out donations to Edward Snowden."
"In a post on Reddit's Bitcoin subreddit , members pledged to donate to the whistleblower's relief fund, despite the wording of the new executive order suggesting that doing so was illegal," ZDNet noted.
While many people are convinced the executive order forbids sending bitcoin to Snowden, that seems likely at present, according to a published account on Motherboard .
Ives said that he made his contribution to the Snowden fund knowing that the penalty for violating the executive order was the potential seizure of his property.
He noted that he's not alone: So far, Ives said, nearly 1,000 donations valued at $46,342.09 in US dollars have poured into Snowden's Bitcoin "wallet" since the executive order was signed on Wednesday.
